YOU AGREE TO READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR WEBSITE. Your use of this website is expressly conditional on your acceptance of the following terms and conditions. RESPONSIBILITY:  This travel agency acts only as agent in all matters connected with the making and securing of reservations for transportation, accommodations, tours, and/or other arrangements for the retail clients of this agency and for various disclosed principles and contractors in the for of airlines, ship lines, tour wholesales, limousine services, and owners or contractors providing accommodations, transportation, and/or other services, hereinafter referred to as "suppliers."  This travel agency does not own, manage, control, or operate any transportation vehicle, hotel, restaurant, insurance company, tour or sightseeing company or any other service that would fir into the classification of "supplier."  As an agent, all related tariffs as well as the terms and conditions specified by each "supplier."  The acceptance of coupons, exchange orders, receipts, contracts, and tickets shall be deemed to be consent to the foregoing conditions and also to the further condition that neither this agency nor any of our representatives shall be or become liable or responsible nor liable for defaults of "suppliers" or any other person, company or incorporation not directly under our control. East Town Travel and or our Affiliates shall not be responsible for any incidents of damaged, lost or stolen luggage or personal items. Any incidents of loss or damage should be reported in writing directly with your insurance company.

Your usage of our website hereby releases East Town Travel and our affiliates from any responsibility for verification of nationality, passport or other requirements for entry to chosen destinations. You assume full responsibility for verifying all safety and security conditions for travel and agree that East Town Travel and or our affiliates are not responsible for any potential hazards or risks related to travel to destinations listed on the website. East Town  Travel and our affiliates assume no responsibility for any or all health, sanitation, cuisine or telecommunications services nor is East Town Travel or our affiliates responsible for any acts of terrorism, war, social or labor unrest, civil disturbances, arbitrary changes in government policies, climate conditions, military activity, emergency evacuation methods, political instability, or standards of hygiene. By purchasing or embarking on travel arranged through or associated with East Town Travel , our website or one of our affiliated websites, you voluntarily assume all risks associated with such travel.

Important Change in International Travel Requirements. 

 

o        Beginning on January 23, 2207 all persons - including U.S. Citizens - traveling by air from Canada, Mexico, the Caribbean and Bermuda will be required to have a passport to enter the United States. (Non-US Citizen please see www.travel.state.gov or www.dhs.gov ) NOTE: Changes will be implemented in phases.  Please refer to the websites provided above.

o        Domestic Travel (with the U.S) requires a government issued ID. (State issued ID or Driver's License)

 

Note: Please ensure you provide the date-of-birth and the legal names that appear on the official documentation.  

ADDITIONAL TERMS: Separate terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select through the third-party suppliers. You agree to abide by the terms or conditions of any supplier with whom you elect to purchase travel products and services from, including, but not limited to, payment of all amounts when due and compliance with all rules and restrictions regarding availability of fares, products, or services. You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of our website.

GROUP RESERVATIONS: You are responsible for contacting your booking agent to CANCEL YOUR GROUP RESERVATION. If you DO NOT cancel your reservation prior to the penalty period (usually within 75 days of scheduled departure), AND you have paid LESS than the per person penalty amount on your account, THEN you will be responsible for paying the outstanding amount due. Please be aware...your group's travel documents will NOT be released by the cruise line or the tour operator until this balance has been satisfied in full. As a result, we strongly encourage all cancellations to be communicated to your booking agent prior to the 75 day deadline. Please consult your agent should you have any questions about our cancellation policies.

 

INSURANCE:  Protect your travel investment.  We strongly encourage the purchase of Airline Ticket insurance which covers your “non-refundable” airline tickets and more if you are prevented from traveling due to an injury, sickness or other covered events. .Airline and other travel suppliers insurance for baggage have limited liability.  Your personal insurance may not adequately cover losses incurred by cancellation, accident, illness or stolen or damaged property.  We strongly urge you to purchase additional insurance offered to you.  

LOST AIRLINE TICKETS:  Lost, stolen, or destroyed tickets must be paid for until refund is obtained from the issuing airline, subject to an airline imposed service charge.

PREPAID AIRLINE TICKETS:  If your travel agent arrangement involved a request for prepaid airline tickets, picked up by the passenger at an airline ticket counter, please note that most carriers require a mandatory non-refundable service charge.  We appreciate your understanding of this charge imposed by the airline and not by our office.

East Town Travels' Refund, Cancellation, and Change Policy for Airline Tickets...  

CHANGES OR CANCELLATIONS:  ***ALL AIRLINE TICKETS ARE NON-REFUNDABLE AND NON-TRANSFERRABLE***. To change or cancel your flight itinerary, call the airline company on which your flight is scheduled, as this agency is not authorized to refund or make changes to airline tickets sold at restricted rates. If you change your plans while traveling, request the issuing airline company to apply the value of your unused ticket toward the purchase of a new ticket.  If a refund is due, the airline will be responsible for processing your refund.  PLEASE BE ADVISED:  There is normally a change/cancellation fee imposed by the airline company of $100 to $150 per ticket, plus the difference between the ticketed fare and the requested itinerary.  ANY Refunds, Credits, and Fee Waivers are at the sole discretion of the issuing airline company. If you choose to utilize East Town Travel to change or cancel your airline reservation, East Town Travel will charge an additional amount over and above the above charges accessed by the airline.

East Town Travels' Refund, Cancellation, and Change Policy for Hotel Reservations...  

CHANGES OR CANCELLATIONS:  If you are holding guaranteed hotel reservations, you need to cancel by notifying the hotel as soon as possible, no later than 24 hours prior to scheduled arrival to avoid mandatory payment of one (1) night’s stay, including taxes). NOTE:  Some hoteliers require 48 hours notification; however, your invoice should contain the appropriate notification requirements. If you wish to CHANGE your reservation, contact your East Town Travel reservation agent and we will gladly make the change for you at no additional charge. If you are holding “pre-paid” hotel reservations, you may cancel or change your hotel reservation by contacting your East Town Travel reservation agent and we will gladly change or cancel your reservation.  Please be advised, there is a $40 Change/Cancellation fee imposed by the “pre-paid” suppliers and that charge will be deducted from your refunded amount.  NOTE: Some hotel reservations are non-refundable.

East Town Travels' Refund, Cancellation, and Change Policy for Rental Car Reservations...  

CHANGES OR CANCELLATIONS:  If you are holding guaranteed car reservations, you need to cancel by notifying either your East Town Travels’ reservation agent or the rental car company as soon as possible, no later than 24 hours prior to scheduled pick-up to avoid a possible cancellation fee, imposed by the car rental company. If you wish to CHANGE your reservation, contact your East Town Travels'  reservation agent and we will gladly make the change for you at no additional charge. If you are holding “pre-paid” car rental reservations, you may cancel or change your hotel reservation by contacting your East Town Travels'  reservation agent and we will gladly change or cancel your reservation.  Please be advised, there may be a $40 Change/Cancellation fee imposed by the “pre-paid” suppliers and that charge will be deducted from your refunded amount, if applicable.

 

East Town Travels' Refund, Cancellation, and Change Policy for Ground Transportation (Transfers) Reservations...  

CHANGES OR CANCELLATIONS:  If you are holding pre-paid reservations, you may to cancel by notifying your East Town Travels’ reservation agent, no later than 24 hours prior to scheduled pick-up to avoid a possible cancellation fee, imposed by the our agency. If you wish to CHANGE your reservation, contact your East Town Travels’ reservation agent and we will gladly make the change for you.

 

East Town Travels' Refund, Cancellation, and Change Policy for Vacation Packages (Individuals & Groups)...

 

CHANGES OR CANCELLATIONS:  ***ALL AIRLINE TICKETS ARE NON-REFUNDABLE AND NON-TRANSFERRABLE***, unless Vacation Package Protection was purchased. To make changes or cancel your vacation package, contact your East Town Travels’ reservation agent and we will gladly make the change or process your cancellation for you. PLEASE BE ADVISED: If Trip Cancellation Insurance was NOT purchased, you will be penalized according to the rules of the original cancellation/change policy, outlined in your reservation confirmation documentation.  If Trip Cancellation Insurance WAS purchased, and you are due a refund, the tour operator will credit the amount outlined in your original reservation confirmation documentation, minus the cost of the insurance.  The remaining funds will be refunded by the insurer, according to the policy purchased, in most cases by the insured filing directly with the insurer

ATTENTION: The reason for cancellation must be a medical condition or other specified cause deemed by the contracted insurance provider.  UNLESS: You paid the additional amount to the insurance company that offers 'cancel for any reason'.

 

East Town Travels' Refund, Cancellation, and Change Policy for Cruises (Individuals & Groups)...

Up 76 Days prior to travel: East Town Travel does impose a $25.00  fee to process any change requests to any cruise reservation.

46 to 75 Days prior to travel: East Town Travel impose a fee to process any change requests to any cruise reservation. However, a fee by the cruise line (plus a  $50 by East Town Travel) per person fee will be imposed for any cancellation requests between 46 and 75 days prior to the scheduled departure. All other change and cancellation penalties imposed will be by and at the discretion of the cruise line, based upon travel insurance, if purchased.  

31 to 45 Days prior to travel: East Town Travel  imposes a fee to process any change requests to any cruise reservation. Any cancellation requests between 31 and 45 days prior to the scheduled departure will incur a 60% Cancellation Penalty (or whatever is imposed by the cruise line) All other change and cancellation penalties, if applicable, will be imposed by and at the discretion of the cruise line, based upon travel insurance, if purchased (highly recommended).  

0 to 30 Days prior to travel: East Town Travel imposes a fee, in addition to any charges imposed by the cruise line, to process any change requests to any cruise reservation. However, any booking cancelled within 30 days of the scheduled departure, if travel cancellation insurance was not purchased, will be penalized at 100% of the cost of the cruise vacation, resulting in "No Refund" ($0.00).

Trip Insurance: If Trip Insurance is purchased, and you need to cancel your cruise reservation, All funds will be refunded by the insurance carrier. (except for the cost of the insurance premium) Note: Insurance covers baggage, trip cancellation/interruption* and medical expense coverage for your vacation. Remember, most major medical policies do not provide coverage outside the U.S.  ATTN: Reason for cancellation must be a medical condition or other specified cause deemed by the contracted cruise line.

 

Although not required, East Town Travel strongly urges the purchase of Trip Cancellation Insurance.  Contact your agent for detailed pricing, policy information, and coverage options.

GOVERNING LAW: This Agreement and its performance shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict of laws provisions. You and East Town Travel agree to submit to the exclusive jurisdiction over all disputes, questions and controversies arising out of your use of our website and these Terms and Conditions hereunder and venue in an appropriate state or federal court located in the state of Wisconsin. To the extent allowed by applicable law, any claim or cause of action arising from or relating to your access or use of this site must be brought within two (2) years from the date on which such claim or action arose or accrued.

DISPUTE RESOLUTION: If any dispute arises between the parties with respect to the interpretation or enforcement of this Agreement, You agree to attempt to resolve such dispute or disagreement by negotiating in good faith and if they are unable to resolve the dispute within thirty (30) days from commencing negotiations, they shall submit it to binding arbitration under the rules and regulations of American Arbitration Association. The arbitration will be final and binding and the arbitrator’s order will be enforceable in any court of competent jurisdiction; provided, however, that if the arbitrator fails to follow the law, the aggrieved party may seek judicial relief. In the event of litigation or arbitration between the parties arising out of this Agreement, the prevailing party will be entitled to recover court or arbitration costs and reasonable fees of attorneys, accountants and expert witnesses incurred in connection with the action or arbitration. Any dispute resolution proceeding, whether administrative or judicial, shall take place in Milwaukee County, Wisconsin.

Nothing in these Policies and Procedures shall prevent East Town Travel from applying to and obtaining from any court having jurisdiction a writ of attachment, temporary injunction, preliminary injunction, permanent injunction or other relief available to safeguard and protect East Town Travels' interest prior to, during or following the filing of any arbitration or other proceeding or pending the rendition of a decision or award in connection with any arbitration or other proceeding.

INJUNCTIVE RELIEF: You acknowledge that a violation or attempted violation of any of these Terms and Conditions will cause such damage to East Town Travel as will be irreparable, the exact amount of which would be difficult to ascertain and for which there will be no adequate remedy at law. Accordingly, you agree that East Town Travel shall be entitled as a matter of right to an injunction issued by any court of competent jurisdiction, restraining such violation or attempted violation of these Terms and Conditions by You, or your Affiliates, partners, or agents, as well as recover from you any and all costs and expenses sustained or incurred by East Town Travel in obtaining such an injunction, including, without limitation, reasonable attorney's fees. You agree that no bond or other security shall be required in connection with such injunction.

SEVERABILITY: If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

HEADINGS: The headings used in these Terms and Conditions are included for convenience only and will not limit or otherwise affect the terms and conditions herein.

ENTIRE AGREEMENT: These Terms and Conditions represent the entire understanding between you and East Town Travel and your use of our website and our services, accepting reservations, airline tickets, invoices or other confirmations or communications of booking travel constitutes your consent to these Terms and Conditions.
